Agenda Item Summary: ACPS is interested in adopting guidelines for the implementation of the Public-Private Education Facilities and Infrastructure Act of 2002. The Public-Private Education Facilities and Infrastructure Act of 2002 (Va. Code § 56-575 et seq.) (“PPEA”) will allow Alexandria City Public Schools to enter into public-private partnership agreements to develop needed qualifying projects in a more timely and/or less costly manner. The first project which ACPS plans to use this PPEA policy is to allow for a power purchase agreement (PPA) or energy savings performance contract (ESPC) to provide photovoltaic panels for both the new Douglas MacArthur and Minnie Howard projects.
Background: In recent years, ACPS and the City of Alexandria have been exploring alternate ways to achieve our capital needs. The PPEA of 2002 establishes a framework by which local governments can seek out public-private partnerships to fund, design, operate or maintain educational facilities and other associated assets. The Act requires that each government entity create its own guideline by which it will accept public-private partnership proposals.
Recommendation: The Superintendent recommends that the School Board review the attached draft of ACPS’s PPEA guidelines and approve them on Nov 11, 2021.
