Agenda Item Summary:
Changes to the Code of Virginia took effect July 1, 2018 that impact school nutrition programs under Policy JHCH and Regulation JHCH-R. As part of the Board’s continuing policy review, we recommend it approve the resulting statutory policy revisions presented to the Board at its February 21, 2019 meeting. Policy JHCH: School Meals and Snacks & JHCH-R: Regulations for School Meals and Snacks - Last reviewed in 2017, Policy JHCH and Regulation JHCH-R have been revised to reflect the enactment of Va. Code § 22.1-79.7 by HB 50/SB 840. As a result, local school boards must have policies to protect students from overt identification if they owe any unpaid meal charges or cannot pay for a meal at school.

Policy JHCH’s implementing regulation, JHCH-R, was created in 2017 to address new U.S. Department of Agriculture (USDA) requirements for school divisions to develop consistent and transparent meal charge policies. In addition, the 2017 amendment of Va. Code §22.1-207.4:
• created regulatory exemptions to the nutritional guidelines for “competitive foods” (i.e., food available for sale to students during the school day other than meals provided by School Nutrition Services (SNS)); and
• required school divisions to determine a specified number of exempt, school-sponsored fundraisers that may be held during school hours, not to exceed 30 per year per school.

These sections of Regulation JHCH-R have been updated to align with current statutory requirements and Board of Education (BOE) regulations. ACPS’ compliance with Policy JHCH and Regulation JHCH-R will be assessed as part of its upcoming SNS federal review in March 2019.
 
Background:
The Code of Virginia § 22.1-253.13:7 and Policy BF require the School Board to maintain and follow up-to-date policies, and that all policies shall be reviewed at least every five years and revised as needed.  
Recommendation
The Superintendent recommends that the School Board approve the attached revisions to Policy JHCH and Regulation JHCH-R.
